Marketplace.Live Shipping Insurance Terms & Conditions (Effective 2/26/2025, Revised)

1. Introduction

These Terms and Conditions govern the process and eligibility criteria for filing claims on lost, damaged, or stolen shipments. This insurance is a buyer-facing program and does not remove the seller's obligations under marketplace policy. In cases where insurance is purchased, Marketplace.Live may still contact the seller to assist in resolution and may seek reimbursement where seller error is found.

If you did not purchase Marketplace Shipping Insurance at checkout, your claim must be made directly with the seller via your buyer account. Sellers are not responsible for theft after delivery confirmation.

2. Coverage Scope

Shipping insurance covers:

  • Lost shipments

  • Damaged items

  • Stolen packages (after delivery, with supporting documentation)

Coverage is valid only for U.S.-based shipments that meet all listed requirements.

3. Eligibility Requirements

To qualify for a claim: a) Submit within 5 days of delivery date or expected delivery date. b) Provide documentation:

  • Proof of shipment and tracking

  • Description of item(s)

  • Photos of damaged goods/packaging

  • Police or incident report (for stolen items)

  • Declaration of non-receipt, and geolocation scan if delivery failed c) Damaged items must be returned to Marketplace.Live (not the seller). A prepaid return label will be provided.

4. Exclusions

Insurance will not apply to:

  • Prohibited/restricted items

  • Packages left outside or unsecured

  • Address entry errors by buyer

  • Claims made after 5-day window

  • Losses caused by natural disasters

5. Claims Process

a) File through online chat or reply to your order email b) Provide all required documentation c) Marketplace.Live will conduct an investigation

  • May involve third-party agents or insurers d) If approved, compensation may be issued as refund, repair, or replacement

e) If the seller is found to have contributed to the issue (e.g., no tracking, poor packaging), the marketplace reserves the right to recover compensation costs from the seller’s future payouts

6. Compensation Limits

a) Maximum: $5,000 per claim / $2,500 per item b) Compensation is limited to the declared item value c) Depreciation may apply

d) Claims exceeding declared value will not be honored beyond the compensation cap

7. Limitation of Liability

Marketplace.Live is not liable for:

  • Indirect or consequential damages

  • Business loss or delays

  • Third-party courier or customs issues

8. Insurance Fees

a) Optional and calculated at checkout based on item value b) Non-refundable once coverage begins

9. Dispute Resolution

Any disputes are subject to the dispute resolution terms of our Customer Agreement. Fraudulent or bad faith claims will be denied.

10. Changes to These Terms

We may revise these terms at any time. Changes are effective upon posting.

11. Governing Law

All claims and interpretations are governed by the laws of Brazos County, Texas.
